The Ohio House recently passed HB 228.

It is an extreme version of a “Stand Your Ground” law that will make our communities less safe and take local control away from cities and municipalities to pass life-saving gun regulations. The bill is now in the Ohio Senate for approval.  This extreme and dangerous bill is opposed by the Ohio Fraternal Order of Police, the Ohio State Highway Patrol, the Ohio Association of Police Chiefs, the Ohio Prosecuting Attorneys Association, Ohio Coalition Against Gun Violence, the NAACP, and many others.

Stand Your Ground and more Preemption – HB228 allows:

  1. That cities and their populations are denied the right to determine their safety (preemption) by penalizing them if they attempt to regulate guns
  2. That lethal force should be the first line of defense
  3. That fear and/or danger justifies suspension of rational
  4. That any citizen may with impunity act on an ad hoc basis, as judge, jury, and executioner of his fellow citizens
  5. That some citizens are not entitled to the cherished right to a trial by a jury of his/her peers and, instead, legally may be judged unworthy of that right by one angry or fearful citizen that feels they may be in danger.
  6. That minimally trained or untrained, unsupervised civilians should have authority to use lethal force in ways that are currently prohibited to our highly trained police
  7. That society is better served by street justice than by the rule of law
